August 15, 2005 —O'Steen & Harrison filed suit against GlaxoSmithKline on behalf of a family whose loved one died after suffering a serious asthma attack. Shortly after using his Serevent inhaler, our client doubled over, unable to catch his breath.

The lawsuit contends Serevent is defective as designed and is unreasonably dangerous. Serevent wasn't subject to a black box warning as a result of adverse reactions like these until August 2003, nearly four years after the death of our client.

Serevent is a popular asthma drug manufactured by GlaxoSmithKline. Serevent is intended for long-term treatment of asthma, and is not an alternative to a fast-acting asthma inhaler.
FDA Strengthens Serevent Warning

March 8, 2006—The FDA announced Serevent will include a Black Box Warning informing patients that the drug may increase the risk of asthma-related death.

Serevent has included a Black Box Warning since August 2003 when a clinical trial assessing the safety of Serevent found that Serevent users were more likely to suffer life-threatening asthma attacks. The results of the study are alarming—36 people either had life-threatening attacks or died while on Serevent. The risk of death was threefold among those taking Serevent compared to a placebo.

The FDA said that while Serevent decreases how often asthma attacks occur, the inhaler may make the attacks that do occur more severe.

In May 2006, the FDA said that Serevent and two other asthma drugs associated with life-threatening attacks should only be used after other medicines fail to control asthma.

FDA Researcher Concerned About Serevent Side Effects

Dr. David Graham of the FDA testified before Congress in November 2004 that he was concerned about the safety of Serevent. He believed the warnings in effect at the time were insufficient and suggested more stringent action be taken to protect asthma sufferers.

Following Dr. Graham's testimony, the FDA created a panel to review the safety of Serevent and two other asthma drugs. The panel recommended that the drugs continue to be sold in spite of evidence of the serious risk to users.

The FDA did, however, strengthen the warning by alerting patients that Serevent may increase the risk of death. The FDA has come under fire in the last several years for its failure to protect the public from Vioxx, a popular arthritis drug found to greatly increase the risk of heart attacks and strokes.
